Alleged killer asks Northampton County Court to pay for expert witness

 

 

The Bath man accused in the 2000 murder of a housemate wants Northampton County Court to approve paying for a forensic anthropologist who would assist in his defense.

Robert Schmidt petitioned Northampton County Judge Leonard Zito to hire forensic anthropologist Dennis C. Dirkmaat from Mercyhurst College in Erie for $300 an hour. Authorities charged the 56-year-old in July with a single count of criminal homicide in the death of then 26-year-old Robert Sarko.


Defense attorney Alex Karam filed the paperwork today on Schmidt’s behalf. Police allege Schmidt fatally shot Sarko and buried his body on a Moore Township property in 2000. Authorities also accuse Schmidt of misleading police during the investigation into Sarko’s disappearance.


During Schmidt’s September preliminary hearing, the district attorney’s office presented a report from forensic anthropologist Thomas Christ, who offered a cause and estimated time of Sarko’s death, according to court records. An excavation crew discovered remains in 2004 and DNA tests in 2010 revealed they were Sarko’s.


Schmidt, who is currently in Northampton County Prison, would be “greatly prejudiced” if the court does not appoint an anthropologist, thus depriving Schmidt of his due process, according to court records. Schmidt is indigent and cannot afford the $1,500 expense, records indicate.
If approved, Northampton County would pay the fee.
