Police officer jailed for misuse of force intelligence computer

Picture of keyboard for Your Expert Witness story, courtesy of freeimages.co.ukA former Nottinghamshire police officer who misused the force's computer system to access information about friends, partners and associates has been jailed.

Robert Kirk pleaded guilty to one count of misconduct in a public office when he appeared at Derby Crown Court earlier this month. He appeared at the same court again today on 22 October and was sentenced to eight months in prison.

Kirk had been a constable based in the force's intelligence unit until an investigation began two years ago. He resigned at the start of October after admitting the offence.

An investigation by the force's professional standards department stated that Kirk had, without reasonable justification, repeatedly accessed the Nottinghamshire Police computer systems for a non-policing purpose over a number of years, namely to conduct 490 searches to view data relating to family members, associates, and persons he was or had been in a relationship with.

Afterwards, investigating officer DI Rob Allison said: "The sentence handed down to Robert Kirk today should send a clear message that no one is above the law. As we have stated before, Kirk repeatedly exploited his position, which gave him access to confidential information not just about the individuals he had become personally involved with, but potentially, many hundreds of people.

"Trust and integrity are paramount to the police service, and action will be taken against those individuals whose conduct falls below the standard that the public would expect of officers. If their actions have broken the law in any way, then we will have no hesitation in commencing a full investigation and working with the Crown Prosecution Service to prosecute that person.

"That is what has happened to Robert Kirk. After 27 years' service he has lost his job and now he must serve a prison sentence, which is perhaps the greatest indignity to befall any serving police officer."
